Damen shipyard seeks €4.7 billion from Germany over cancelled F126 frigate project

The Dutch shipyard Damen Schelde Naval Shipbuilding (DSNS) is pursuing multi-billion euro claims against the German government following the cancellation of the F126 frigate program. Represented by lawyer Peter Gauweiler, Damen is demanding approximately 4.7 billion euros in contractually obligated payments and indemnification, asserting that the cancellation was politically motivated and lacked legal basis.

German Defense Minister Boris Pistorius halted the project on June 24, citing significant delays, rising costs, and unpredictable risks. The Ministry estimated that continuing the program could have driven total costs above 18 billion euros. In response to the cancellation, Germany has opted to purchase eight MEKO A-200 frigates from ThyssenKrupp Marine Systems instead.

The dispute involves significant counterclaims. The German Ministry of Defense has indicated it may seek 2.3 billion euros from Damen due to alleged failure to meet contractual obligations and poor performance. Damen, however, maintains that the German government is responsible for the project's delays and has requested a legally binding guarantee to cover existing and future losses.
