Danıştay stays execution of İnciraltı regional zoning plans
The Council of State (Danıştay) 6th Chamber has issued a stay of execution regarding the 1/100,000 scale Environmental Plan Amendment for the Izmir-Manisa Planning Region. The decision follows a lawsuit filed by the TMMOB Izmir Provincial Coordination Board, which argued that the plan lacks legal basis and violates principles for protecting natural and agricultural areas.
A central point of the dispute involves a 47-hectare area designated as a second-degree natural site. The plan sought to reclassify this area from a “Preferred Use Area” to a “Tourism Facility Area.” TMMOB contends that the legal foundation for the area's status as a tourism center was previously annulled by the judiciary.
In response to the ruling, the İnciraltı Development Association (İNGEDER) clarified that the court's decision pertains to an older plan approved in April 2025. İNGEDER stated that a revised 1/100,000 scale Environmental Plan approved on April 8, 2026, remains in effect. The association criticized the presentation of the ruling, arguing it creates a false perception that current planning has been halted.
