Data sovereignty and architectural independence in AI
Discussions regarding data sovereignty in the age of artificial intelligence highlight a distinction between owning raw data and maintaining architectural independence. While Palantir CEO Alex Karp advocates for enterprise data sovereignty, critics argue that relying on proprietary platforms can create platform sovereignty risks. Even if a company legally owns its data, it may become dependent on a provider's specific ontology, semantic models, and operational workflows, making it difficult to migrate or operate independently.
Concerns also persist regarding the terms of service provided by major AI model developers like OpenAI and Anthropic. Although these companies often state they will not train on customer content, legal definitions of “Input” and “Output” remain critical. There are questions regarding whether the intermediate reasoning steps produced by newer reasoning models constitute protected output, potentially creating loopholes in data ownership and intellectual property protections for commercial users.
