DataOne fined $1.07M for unpermitted generators in New Jersey

The New Jersey Department of Environmental Protection (DEP) has fined DataOne $1.07 million for violating the state's Air Pollution Control Act. The penalty, the largest ever against a data center in New Jersey, follows the discovery of 62 unpermitted natural-gas power generators at the company's facility in Vineland.

State inspectors identified the 62 Caterpillar G3516H engines, each rated at 1,982 kilowatts, during a site visit on July 29. Under New Jersey regulations, any generator with a capacity of 37 kilowatts or higher requires a preconstruction permit and a valid operating certificate, which DataOne failed to obtain for these units.

DataOne has contested the findings, suggesting the generators should be classified as temporary equipment. The company stated it is working to obtain the required permits and is pursuing a permanent energy solution using Bloom Energy fuel cells. The Vineland site is part of a $17 billion project involving a partnership with Microsoft to serve Nebius Group.
