Dateline Resources and US Government seek to lift mining ban
Dateline Resources and the United States Government have filed motions with the United States Court of Appeals for the Ninth Circuit to overturn a preliminary injunction halting work at the Colosseum gold and rare earths project in California.
The project, located within the Mojave National Preserve, is valued at potentially billions of dollars. Dateline Resources argues that its Plan of Operations, approved by the Bureau of Land Management in 1985, constitutes a valid existing right that predates the creation of the preserve. The company claims this right has been recognized by the National Park Service on three separate occasions between 1995 and 2025.
The legal battle involves the National Parks Conservation Association, which originally brought the injunction. The US Department of Justice has filed a motion for a stay, and the Department of War has submitted a declaration stating that exploration at the site is in the national security interests of the United States. A three-judge panel will decide whether to grant the stay based on the merits of the appeal, potential harm, the impact of resuming work, and the national interest.
