D.C. Circuit overturns judgment against James O’Keefe

The D.C. Circuit has overturned a $130,000 judgment against James O’Keefe and Allison Maass in the case of Democracy Partners v. O’Keefe. The original 2022 verdict involved fraud and wiretapping damages stemming from a 2016 investigation into Democratic political consultants.

The appellate ruling addresses a long-standing legal loophole regarding First Amendment protections for journalists. Previously, some plaintiffs attempted to bypass the high bar for defamation claims by public figures—established in New York Times v. Sullivan—by reclassifying reputational harm as economic or non-reputational loss, such as lost contracts or diminished prospects.

The court ruled that the legal nature of the injury, rather than the label used by lawyers, determines the applicability of constitutional protections. This decision aims to prevent plaintiffs from using alternative tort claims to circumvent the requirements of falsity and actual malice in publication-related disputes.
