Debt recovery and installment regulations in Italy

In Italy, debtors have specific legal protections and procedures regarding debt recovery and tax arrears. While creditors with an enforceable title can pursue judicial actions such as bank account seizures or the auction of real estate to satisfy claims, they are prohibited from committing illegal acts. Debtors may file criminal complaints if a creditor engages in abusive or unlawful behavior during the recovery process.

Regarding tax debts managed by the Agenzia delle Entrate-Riscossione, taxpayers can utilize installment plans to manage payments without compromising financial stability. Under Article 19 of the Decree of the President of the Republic n. 602/1973, these plans allow for the gradual settlement of outstanding tax bills. However, maintaining these plans is critical; missing too many installments—specifically reaching the eighth missed payment—can lead to the loss of the installment benefit, making the entire debt immediately due and subject to enforcement actions.
