DEDECON promotes mediation to resolve tax disputes with the SII

The Defensoría del Contribuyente (DEDECON) is highlighting its tax mediation service as an effective administrative tool to resolve disputes with the Servicio de Impuestos Internos (SII) without resorting to lengthy litigation.

In a recent case involving a taxpayer from Puente Alto, a tax discrepancy had escalated from an initial 30 million CLP assessment to over 50 million CLP due to adjustments, interest, and fines. DEDECON professionals identified a discrepancy in how the tax was determined, noting that while some SII observations were correct, the final calculation did not align with the law.

DEDECON presented a formal settlement proposal to the SII based on applicable regulations. The SII accepted the proposal in full, significantly reducing the tax amount owed. The mediation process is described as a non-adversarial, extrajudicial, free, and impartial service available to those who believe their tax rights have been violated.
