Delhi court orders husband to pay child support despite unemployment claim
An Additional Sessions Judge in Delhi, Shital Chaudhary, ruled that a husband cannot evade his legal duty to provide maintenance by claiming unemployment. The court ordered him to pay ₹6,000 per month as alimony for his minor son until the child reaches 18 years of age.
The decision came on appeal against a lower‑court order that had denied relief under the Protection of Women from Domestic Violence Act. The wife alleged that after marrying in February 2013, she faced harassment over dowry, was expelled from her in‑laws' home during pregnancy, and has been living separately with her son since 2015. The appellate court found that the husband had not contributed financially since 2015 and that he is capable of meeting the payment obligation.
