Delhi High Court rules footpaths cannot be encroached upon

The Delhi High Court has ruled that footpaths are strictly intended for pedestrian use and cannot be subject to encroachment. Justice Jasmeet Singh issued this observation while refusing to grant immediate relief to the Lohar Basti Lal Bagh Azadpur Vikas Samiti, a residents' group challenging a demolition notice.

The group had petitioned to quash a notice issued by the Public Works Department on August 7, which targeted the removal of jhuggies (shanties) constructed on government land along GT Karnal Road. The petitioners sought a survey of residents to determine eligibility for rehabilitation and resettlement before any demolition occurred.

Upon reviewing photographic evidence, the Court noted that the structures were built on the footpath, storm water drains, and the Right of Way. While declining to stay the demolition, the Court ordered the Public Works Department to consider the petitioners' representation regarding the matter within four weeks.
