Denis Bećirović challenges ban on Army of BiH symbols

Denis Bećirović, the Chairman of the Presidency of Bosnia and Herzegovina, has submitted a request to the Constitutional Court of Bosnia and Herzegovina to assess the constitutionality of amendments to the Criminal Code of Republika Srpska. These amendments criminalize and prohibit the public display and promotion of the flags and symbols of the Army of the Republic of Bosnia and Herzegovina.

Bećirović argues that these amendments constitute an attack on the constitutional order of Bosnia and Herzegovina, the Dayton Peace Agreement, and the fundamental human rights and freedoms protected by the European Convention on Human Rights. He maintains that Republika Srpska lacks the constitutional authority to regulate or prohibit the symbols of state organs, asserting that such matters fall solely under the jurisdiction of the state-level authorities of Bosnia and Herzegovina.

Furthermore, Bećirović stated that the symbols of the Army of the Republic of Bosnia and Herzegovina were adopted legally by the internationally recognized Republic of Bosnia and Herzegovina and that their constitutionality remains continuous under the current Constitution of Bosnia and Herzegovina.
