Dentist sentenced to 5 years for HIV transmission in Porto Velho

A judge in Porto Velho has sentenced dentist Jean José Dunga de Oliveira to five years and five months in prison for bodily injury. The court found that Oliveira deliberately omitted his HIV-positive status during sexual relations with an ex-girlfriend, resulting in her infection.

In addition to the prison sentence, the defendant was ordered to pay R$ 50,000 in compensation to the victim. The ruling, delivered by Judge Keila Roeder, utilized the National Council of Justice’s Protocol for Judging with a Gender Perspective. This methodological approach considers the vulnerability of the victim and the breach of trust involved in the information asymmetry.

The case is notable in the Northern region as it marks a significant application of gender-based judicial guidelines. The Public Ministry of Rondônia has noted that the case may involve up to four confirmed victims. The decision is subject to appeal.
