Denver judge dismisses residency challenge against Jessica Killin
A Denver District Court judge has dismissed a petition seeking to disqualify Democratic candidate Jessica Killin from the ballot in Colorado’s 5th Congressional District. The ruling, issued on October 30, comes just days before the November 3 election.
The petition, filed by Wayne Laugesen, a former editor for the Colorado Springs Gazette, argued that Killin failed to meet the constitutional requirement of being an inhabitant of the state. The challenge cited a Maryland property tax bill as evidence that Killin maintained her principal residence in Chevy Chase, Maryland, rather than Colorado.
The judge dismissed the case with prejudice, ruling that the petition was filed outside the five-day window permitted under Colorado law to challenge a candidate's qualifications. The court noted that the law allows no exceptions to this deadline, regardless of when new evidence is discovered. Additionally, the judge rejected arguments that the Secretary of State had a duty to reconsider Killin's eligibility, citing that ballots had already been mailed and many voters had likely already cast their votes.
