Denzel Aberdeen sues NCAA for fifth year of eligibility

Florida basketball guard Denzel Aberdeen has filed a lawsuit and a temporary injunction against the NCAA to secure a fifth year of collegiate eligibility. Represented by attorney Jesse Panuccio, Aberdeen seeks to return to the University of Florida to complete his degree and compete under the NCAA’s ‘5-in-5 rule.’

The legal challenge centers on an unwritten exception within the NCAA’s new eligibility framework. While the rule allows for five years of eligibility, Aberdeen’s legal team argues that the NCAA is unfairly stripping students from the Class of 2022 of this benefit. They contend this decision violates the organization’s contractual commitment to fairness, especially as other athletes who competed against older seniors received waivers.

Aberdeen, a former member of Florida’s 2025 national championship team, transferred to the University of Kentucky last year before reenrolling at Florida to finish his undergraduate studies. He has been practicing with the Gators throughout the summer.

This case is part of a broader legal movement regarding the NCAA’s age-based eligibility model. According to the filing, there are approximately 79 lawsuits involving 450 plaintiffs across various sports contesting the implementation of these rules.
