Deutsche Umwelthilfe challenges Building Modernization Act in court

The environmental NGO Deutsche Umwelthilfe (DUH), alongside four tenants, has filed a constitutional complaint with the Federal Constitutional Court against the Building Modernization Act (GModG).

The DUH argues that the law is unconstitutional because it violates the state's obligation under Article 20a of the Basic Law to protect natural foundations of life and ensure climate protection for future generations. The organization contends that by allowing the continued installation of fossil-fuel-powered heating systems, the law fails to provide a clear path toward climate neutrality and instead creates long-term reliance on fossil fuels.

According to DUH Federal Managing Director Barbara Metz, the legislation risks creating significant additional emissions and imposes unpredictable costs on tenants, who may ultimately be forced to pay for heating decisions they did not make. The complaint seeks to have the court set legal limits on the law to ensure compliance with constitutional climate mandates.
