Diageo wins dismissal in U.S. tequila labeling class-action lawsuit

A U.S. District Court judge has dismissed a class-action lawsuit against Diageo that alleged the company falsely labeled its Don Julio and Casamigos tequila brands as ‘100% agave’. The lawsuit, brought by consumers and restaurants, claimed the products were adulterated and sought damages for personal injury and economic loss.

Judge LaShann DeArcy Hall ruled that the plaintiffs failed to provide sufficient evidence of systemic mislabeling. The court specifically noted that the plaintiffs’ claims relied on a single study involving only five samples, which was deemed too small to reasonably infer ubiquitous mislabeling across the brands.

Diageo maintained that both Casamigos and Don Julio are produced using 100% Blue Weber agave. A company spokesperson stated they were gratified by the decision, calling the allegations ‘baseless’ and affirming the quality and integrity of their products.
