Dimone Fleming found not guilty by reason of insanity in NYC child deaths
A Bronx judge has found Dimone Fleming not guilty by reason of mental disease or defect for the 2022 deaths of her two children, 3-year-old Daishawn Fleming and 11-month-old Octavius Canada.
Fleming, who was 22 at the time of the incident, was charged with first-degree murder after the children were found with multiple stab wounds in a bathtub at a Bronx family shelter. Mental health evaluations conducted by both the prosecution and the defense concluded that Fleming was suffering from postpartum psychosis during the killings. Psychiatrist Dr. Eric Goldsmith testified that Fleming was “grossly psychotic and out of touch with reality,” experiencing hallucinations and believing a spirit had invaded her body.
Court records indicate that Fleming had previously been treated for major depressive disorder in Queens but had not followed her prescribed medication regimen and was using marijuana daily, which reportedly exacerbated her symptoms. Fleming will not be released from custody; a new evaluation has been ordered to determine if she remains a threat to others, with a court date set for September 18.
