Diyarbakır court orders unpaid salary payment for teacher
The Diyarbakır 2nd Administrative Court has ruled that a contract teacher in the Dicle district must be paid unpaid wages with legal interest. The ruling follows a lawsuit regarding a teacher whose contract was suspended during an investigation, resulting in no salary payments between March 15 and July 5, 2024.
The court determined that the concept of 'suspending a contract' does not exist in current legislation. Instead, the court classified the action as a 'suspension from duty.' Under this classification, the court emphasized that provisions from Civil Servants Law No. 657 regarding the financial protection of suspended employees should be applied by analogy to contract personnel.
The decision states that because the teacher's contract remained in effect during the period in question, the refusal to pay the salary was not legally sound.
