dm eye screening service faces legal challenge in German court

The Landgericht Karlsruhe is presiding over a legal dispute regarding eye screening services offered by the drugstore chain dm. The Wettbewerbszentrale, an organization representing leading German business associations, has taken legal action against the retailer, alleging that the €14.95 screenings violate various legal requirements, including the Heilpraktikergesetz (Naturopath Act).

The Wettbewerbszentrale argues that screenings for eye diseases should not be conducted by non-physicians in retail environments and that such services should not be advertised, citing the need to maintain medical standards for patient protection.

Dm maintains that the service, which utilizes artificial intelligence for evaluations such as glaucoma detection and is medically supervised, does not violate current law. Sebastian Bayer, dm's Managing Director of Marketing and Procurement, stated that the company seeks legal certainty and intends to appeal any unfavorable ruling at the regional court. The screenings are currently offered in select locations and dm has expressed interest in expanding the program to more branches.
