Dominican Constitutional Court rejects Telemicro's legal action over channel 3

The Dominican Republic's Constitutional Court has declared an amparo action filed by Telemicro inadmissible. The media company had sought to compel the Dominican Institute of Telecommunications (Indotel) to prevent third parties from using or promoting channel 3.

Telemicro argued that Indotel should have enforced a previous resolution and communication that warned companies to abstain from using the frequency during an ongoing dispute. However, the Court concluded that these documents did not constitute a concrete or immediately enforceable order against Indotel. The Court noted that determining whether these acts suspended the rights of other operators would require complex legal interpretations beyond the scope of an amparo de cumplimiento. This ruling does not resolve the underlying dispute regarding the ownership and rights to the channel frequency.
