Dominican Constitutional Court Reviews Abortion Law Compatibility

Organizations including Alianza Cristiana Dominicana and Católicas por el Derecho a Decidir República Dominicana filed a Direct Action of Unconstitutionality (ADI) before the Dominican Constitutional Court challenging provisions of Law 74‑25. They argue that the three abortion‑related causals in the penal code are compatible with the Dominican Constitution, which requires a systematic interpretation that balances the protection of prenatal life with the rights to life, health, dignity, equality and personal integrity of women, adolescents and girls.

The petition cites tragic cases such as Rosaura Almonte Hernández (known as “Esperancita”), Damaris Mejía, Carmen Dionelys Martínez Bonilla and Winifer Núñez Beato to illustrate how legal uncertainty can delay or prevent necessary medical care. The claim invokes article 74.4 of the Constitution, which mandates harmonising fundamental rights to ensure the broadest protection of the person, and seeks a ruling that affirms the Constitution’s integral protection of these rights.
