Dominican Finjus Criticizes Electoral Tribunal's Referral of Poll Rule to Constitutional Court

The Fundación Institucionalidad y Justicia (Finjus) warned that the Tribunal Superior Electoral (TSE) should have retained jurisdiction over a legal challenge to the Junta Central Electoral's Resolution 14‑2026, which regulates when electoral opinion polls may be published. Finjus argued that the TSE's decision to declare itself incompetent and refer the case to the Tribunal Constitucional undermines the specialized role of the electoral court and distorts the constitutional balance intended by the framers.

Finjus emphasized that merely citing constitutional provisions does not automatically transform a contestable administrative regulation into a direct constitutional action. The organization cautioned that shifting such disputes to the constitutional court could erode the principle of the natural judge and expand constitutional jurisdiction beyond its proper scope.
