Dominican Republic begins Supreme Court judicial selection process

The National Council of the Magistracy (CNM) has commenced public hearings to interview 88 preselected candidates for six vacancies in the Dominican Republic's Supreme Court of Justice (SCJ). The process, which includes selecting a new president for the high court, is being overseen by President Luis Abinader and Vice President Raquel Peña.

A central theme of the hearings has been the impact of the new Penal Code (Law 74-25). President Abinader defended the implementation of cumulative sentencing, arguing that the law must adapt to modern criminal patterns. He specifically noted that individuals with extensive criminal histories face significant challenges regarding social reintegration.

However, several candidates and observers have raised concerns. Judge Rafael Armstrong Báez García warned that increasing sentence lengths through cumulative sentencing may not effectively curb criminality and highlighted the tension between punishment and the constitutional principle of social reintegration. Additionally, the Red de Observadores por la Institucionalidad (ROI) has called for the selection process to prioritize judicial independence, merit, and gender parity, urging the CNM to ensure the new court reflects the professional experience of the judicial career.
