Dominican Republic Constitutional Court holds public hearing on amparo appeal

The Plenary of the Constitutional Court of the Dominican Republic held a public hearing regarding a constitutional review resource (expediente TC-05-2023-0240). The case involves a challenge to Sentence No. 136-2023-SSEN-00035, originally issued by the Criminal Chamber of the Court of First Instance of the Duarte Judicial District.

The hearing was led by President Napoleón R. Estévez Lavandier and included testimony from the prosecutor for the Duarte province, Smaily Rodríguez, as well as defense counsel. This public session follows a previous attempt to hear the case, which was delayed because the prosecutor failed to appear despite being duly summoned.

Under Article 101 of Law 137-11, the Constitutional Court may convene public hearings in amparo matters to ensure a thorough substantiation of the case.
