Dominican Republic implements criminal procedure reforms

Following the reform of the Criminal Procedure Code via Law No. 97-25 in the Dominican Republic, legal mechanisms intended to provide alternatives to ordinary imprisonment have been strengthened. These include two distinct legal institutes: the conditional suspension of proceedings and the conditional suspension of the sentence.

The conditional suspension of proceedings (Articles 41 to 44) serves as a restorative exit that temporarily halts criminal action during the preparatory or intermediate phases. It applies to offenses with a maximum penalty of five years or less. To qualify, the accused must agree to the terms, admit the facts, and repair damages caused. However, there are concerns regarding judicial misinterpretation, where courts may erroneously demand standards of responsibility typical of a final conviction, potentially undermining the restorative nature of the law.

In contrast, the conditional suspension of the sentence (Articles 347 to 350) represents a different procedural stage and legal foundation, though the two are often confused in practice.
