Dominican Republic implements new Penal Code

The Dominican Republic’s new Penal Code, enacted via Law 74-25 by President Luis Abinader, has officially entered into force following a year of vacatio legis. The new legislation introduces stricter penalties for administrative corruption, defines feminicide, and establishes sanctions for violating restraining orders.

Recent violent incidents, including a double homicide in Villa Jaragua and a feminicide in Montecristi, may be among the first cases prosecuted under this new legal framework. Due to the constitutional principle of non-retroactivity, crimes committed before August 3 will be judged under the previous 1884 code, while all subsequent offenses fall under the new regulations.

In response to the transition, the Cámara de Cuentas is evaluating how the new code affects its institutional responsibilities. President Emma Polanco Melo stated that the institution’s legal team is studying the impact on audit results and potential sanctions. The agency noted that its role is to detect irregularities and refer them to the appropriate authorities, noting that violations can result in administrative, criminal, or civil liabilities.
