Dominican Republic Senate delays corporate criminal liability until 2028

The Dominican Republic Senate has urgently approved a bill to modify Article 31 of Law 44-26, extending the implementation period for certain provisions of the new Penal Code. The amendment specifically targets Articles 8, 9, 10, and 11, which govern the criminal liability of legal entities (corporations).

Under the approved text, these provisions will enter into force on November 5, 2028, providing a 24-month adequacy period for companies to implement necessary compliance programs, prevention policies, and disciplinary mechanisms. This extension moves the deadline from the previously intended 2026 date.

In a separate legislative action, the Senate also approved an urgent modification to Law 339-22 regarding the use of digital media in the Judiciary. This measure aims to modernize judicial services through the use of qualified electronic signatures, document digitalization, and virtual hearings, though virtual proceedings remain excluded for criminal matters.
