Dominican Republic Senate approves Public Ministry Law reform

The Senate of the Dominican Republic has approved a bill in its second discussion to modify Law 133-11, the Organic Law of the Public Ministry. Authored by Senator Ramón Rogelio Genao, the legislation aims to align the law with the Constitution proclaimed on October 27, 2024.

The reform changes the appointment process for deputy prosecutors. Under the new proposal, the Attorney General will have a maximum of 14 deputy prosecutors. Half of these positions will be designated by the National Council of the Magistracy (CNM) following a proposal by the President of the Republic. The remaining half will be selected by the Attorney General from among the prosecutors general of the courts of appeal who meet the necessary requirements.

Additionally, the bill establishes that deputy prosecutors appointed by the CNM will have a two-year term of tenure, with the possibility of confirmation by the CNM at the end of that period, subject to impeachment. The bill now proceeds to the Chamber of Deputies for further consideration.
