Dominican Republic tribunal cancels Falcondo mining concession

The Superior Administrative Tribunal (TSA) has formally annulled the mining concession contracts held by Falconbridge Dominicana, S. A. (Falcondo), which were originally signed in 1956 and 1969.

The decision follows a legal action brought by the Fondo Patrimonial de las Empresas Reformadas (Fonper) on behalf of the Dominican state. The court cited several critical breaches, including the cessation of productive operations at the Quisqueya I site, which has been inactive since November 17, 2023.

Additionally, the tribunal found that Falcondo failed to meet essential economic, labor, and technical obligations. Specifically, the company did not submit required semi-annual progress reports for 2023, 2024, and 2025, nor annual operation reports for 2023 and 2024. The TSA ruled that this inactivity and lack of transparency compromised the national interest regarding the effective exploitation of mineral resources.
