Dominican Republic updates penalties for ‘fullería’ in new Penal Code

The new Penal Code in the Dominican Republic has updated the regulations regarding the crime of ‘fullería’. Under Article 246, the offense is defined as obtaining goods or services without sufficient economic resources to pay, or having the resources but refusing to pay for the services provided.

Penalties for this crime have increased significantly compared to the previous code. The new sanctions include between 15 days and one year of minor imprisonment, along with fines ranging from RD$10,000 to RD$20,000.

Victims may contact the National Police immediately to apprehend an individual in flagrante delicto. Following arrest, the Public Ministry may request coercion measures, which a judge may decide based on the amount owed. Potential judicial outcomes include prison time, bail, economic guarantees, travel restrictions, and orders to pay the original bill, legal expenses, and damages caused to the business.
