Dominican Republic's digital signature framework deemed insecure by INDOTEL
The Dominican Institute of Telecommunications (INDOTEL) issued resolution 057‑2026 to create and regulate notarized digital signatures. Its analysis found no binding technical standard for security requirements and certified profiles, generating legal insecurity and hindering interoperability of electronic notarial acts with key state institutions such as the Judiciary and the Real Estate Registry.
The Chamber of Commerce and Production offers the DIGIFIRMA qualified electronic signature system, claiming full legal validity for corporate documents, contracts and online transactions. However, INDOTEL's resolution 50‑2024, which outlines the application regulation for digital documents and signatures, states that notarized digital signatures must follow existing digital‑signature norms, yet acknowledges regulatory gaps that prevent the creation of a secure notarized e‑signature.
These gaps raise concerns about the legal robustness of digital notarizations and the ability of courts and registries to accept electronic documents under current Dominican law.
