US proposes H-1B visa fees amid escalating trade tensions with Canada

The United States Department of Homeland Security (DHS) has proposed a significant new fee of $103,265 for each H-1B visa application subject to the annual cap. This proposal, which includes applications under the advanced degree exemption, aims to recoup government costs for processing and examination. DHS estimates the new fee could generate approximately $8.8 billion in annual revenue based on roughly 85,000 cap-subject applications.

Simultaneously, trade tensions between the United States and Canada have escalated. Following failed negotiations, Donald Trump has signaled potential new tariffs, including a proposed 50% tariff on Canadian automobiles, trucks, and auto parts starting in 2027. In response, Canadian Prime Minister Mark Carney has promised retaliatory measures. Ontario Premier Doug Ford suggested that Canada could use its exports of energy and critical minerals, such as nickel, uranium, and potash, as negotiating tools in the ongoing trade dispute.
