Drake appeal against Universal Music Group set for December oral arguments

The U.S. Court of Appeals for the Second Circuit has scheduled oral arguments for December 4, 2026, in the ongoing legal battle between rapper Drake and Universal Music Group (UMG). The appeal follows a previous dismissal of Drake’s lawsuit, which alleged defamation, harassment, and deceptive business practices related to the promotion of Kendrick Lamar’s diss track, ‘Not Like Us’.

Drake’s legal team argues that the initial dismissal established a ‘dangerous categorical rule’ by suggesting that statements in rap diss tracks cannot constitute actionable facts. They contend that UMG worked to weaken Drake’s leverage in future contract negotiations. Conversely, UMG is seeking to have the dismissal affirmed, a move supported by various legal scholars and social scientists who have submitted briefs in the company's favor.

The outcome of the oral arguments will determine whether the case is reopened or permanently dismissed. The ruling is expected to have implications for how the music industry handles defamation claims involving artistic expression and rap rivalries.
