Drivers in Brazil and Portugal can contest traffic fines
Motorists who receive a traffic citation can file an appeal within a limited period. In Brazil, the driver – or the vehicle's registered owner – may contest a Detran fine within 30 days of issuance, citing formal errors such as incorrect data or merit errors where the alleged violation did not actually occur. The appeal can be submitted administratively, judicially, or through both channels, and legal assistance is advisable for serious cases.
In Portugal, the process also begins with a careful review of the notice, preservation of a copy, and submission of a written defence supported by evidence such as photos, witness statements, or documents. Ignoring the ticket can lead to increased penalties and points loss on the driving licence. Drivers may also attend remedial training to recover points, and must verify whether the infraction affects licence points before deciding on payment or contestation.
