Colombia JEP imputes former generals for crimes in Medellín

The Special Jurisdiction for Peace (JEP) has imputed war crimes and crimes against humanity to twelve former members of the Colombian public forces, including retired generals Mario Montoya Uribe and José Leonardo Gallego Castrillón. The charges relate to events in Medellín’s Comuna 13 and surrounding areas between 2001 and 2004, specifically involving military operations such as Operation Orion.

The JEP’s Truth and Responsibility Recognition Chamber attributed responsibility to the generals by omission, stating they failed to take necessary measures to prevent or impede violent acts despite their command roles. The investigation identified a macrocriminal pattern involving collaboration between state agents and paramilitary groups, primarily the Bloque Cacique Nutibara. This alliance allegedly facilitated crimes including homicide, forced disappearance, torture, sexual violence, and displacement of civilians.

The judicial decision, part of the Antioquia Subcase of Case 08, documents hundreds of victimizing facts and hundreds of victims. The investigation highlights a dynamic where military and police units would clear sectors to allow paramilitaries to enter and consolidate control.
