Düsseldorf judge acquitted of perversion of justice charges
A judge in Düsseldorf has been acquitted of charges of perversion of justice following a trial at the Amtsgericht Düsseldorf. The court ruled that the necessary intent to commit such an offense could not be proven against the defendant.
The case originated from the judge's refusal to register a woman as the mother of a child born via surrogacy in Ukraine in 2018. The judge stated she had followed the legal guidance of the registry office, which had declined the request because surrogacy is prohibited under German law.
The child's father, a legal professional, had presented a Kyiv court ruling that recognized the couple as the parents. While prosecutor Thomas Tupait noted that failing to consider this ruling was a legal error, he also expressed belief that the judge acted under the assumption that her conduct was lawful.
