Dutch provinces resist permit revocations amid nitrogen crisis

Dutch provincial authorities in Overijssel and Noord-Brabant are facing legal and political pressure regarding the potential revocation of agricultural permits due to nitrogen emissions affecting Natura 2000 protected areas.

In Overijssel, the provincial government has refused requests from the organization Mobilisation for the Environment (MOB) to revoke the permits of 18 farmers. Although these permits were previously considered legally final, recent court rulings suggest they can be revisited if nature protection is deemed insufficient. The province argues against targeting individual entrepreneurs for broader nitrogen issues.

In Noord-Brabant, the provincial government has suspended its decision to revoke permits for five poultry farms. While the province initially aimed to publish a draft decision by October 1, officials stated that more time is needed for confidential discussions with the affected business owners. The legal pressure stems from a court ruling requiring the province to take measures to prevent further environmental degradation, which has subsequently stalled permits for housing and sustainability projects.
