EB-5 visa program offers new filing advantages and reserved visa access
Recent updates to the EB-5 immigrant investor program, driven by the EB-5 Reform and Integrity Act of 2022, have introduced significant procedural advantages for applicants. One major change is the ability for eligible applicants within the United States to utilize concurrent filing. This allows them to simultaneously apply for a green card, employment authorization (work permits), and advance parole (travel documents), reducing the uncertainty of maintaining legal status during the processing period.
Additionally, the availability of reserved visa categories provides a pathway to avoid backlogs affecting unreserved categories, particularly for investors from China and India. Projects located in Targeted Employment Areas (TEAs) benefit from these set-aside visas, with 20% reserved for rural projects and 10% for high unemployment areas. The Hard Rock Pointe Vista project is noted for its dual qualification as both a rural and high unemployment TEA, granting investors access to both reserved visa pools.
