Albania proposes Criminal Procedure Code changes to limit prison arrest
Albanian Prime Minister Edi Rama has presented a draft proposal to amend the Criminal Procedure Code, aiming to align the country with European standards and strengthen the rights of the accused. A central pillar of the reform is the restriction of pre-trial detention. Under the new rules, prison arrest would be treated as a last resort. Specifically, for criminal offenses with a maximum sentence of up to 3 years, restrictive measures would generally not be applied, and for offenses with a maximum sentence of up to 5 years, prison arrest would no longer be mandated as a standard measure.
The proposal also seeks to prevent silence or the refusal of an accusation from being used as evidence of riskiness. Furthermore, judges would be required to provide independent reasoning for their decisions; if a court merely copies a prosecutor's arguments without justifying why milder measures are insufficient, the decision could be deemed invalid and lead to disciplinary action.
While legal experts and officials from the Council of Europe have noted the positive direction of these changes in curbing the excessive use of detention, political opposition has criticized the move. Critics argue the reform may be designed to protect specific individuals currently under investigation from arrest.
