Eduardo Cunha remains ineligible until 2027 after court rejects appeal

The Regional Electoral Court of Minas Gerais (TRE-MG) has unanimously rejected the motion for clarification filed by the defense of Eduardo Cunha, the former President of the Chamber of Deputies. This decision maintains his ineligibility to hold office until February 2027.

Cunha, whose mandate was revoked in 2016 due to a breach of parliamentary decorum, had his attempt to run for federal deputy in Minas Gerais denied by the court. His legal team argued that the eight-year ineligibility period should be calculated from the date of his removal rather than the end of the legislature, which would have allowed him to run in late 2024.

Relator Sálvio Chaves ruled that the previous decision contained no omissions, contradictions, or material errors. Cunha has announced his intention to appeal the decision to the Superior Electoral Court (TSE), claiming the current interpretation of the law is unconstitutional.
