EEOC proposes rescinding workforce demographic reporting requirements
The U.S. Equal Employment Opportunity Commission (EEOC) has proposed a rule to rescind several workforce demographic data reporting requirements, including the EEO-1, EEO-2, and EEO-3 reports. These mandates, which have been in place since 1966, require certain private sector employers and federal contractors to submit data regarding job categories, sex, and race or ethnicity.
The EEOC asserts that the current collections are “overly burdensome, offer insufficient utility, and may be misused.” The agency suggests that generic data collection may encourage discrimination or promote racial stereotyping. The proposed change is estimated to save approximately $275 million annually for the 110,000 employers, 6,000 labor organizations, and 17,000 public entities currently required to file.
While the federal mandate may be removed, legal experts and nonprofit advocates note that Title VII of the Civil Rights Act still prohibits employment discrimination. Advocates argue that organizations, particularly nonprofits, should continue tracking workforce data internally to ensure accountability, evaluate internal systems, and identify barriers to fair hiring and promotion.
