Eleventh Circuit upholds whistleblower provision in False Claims Act

The Eleventh Circuit Court of Appeals has ruled that the qui tam provision of the False Claims Act is constitutional. This provision allows whistleblowers to file lawsuits against fraudsters on behalf of the federal government and receive a share of the recovered funds.

Senate Judiciary Committee Chairman Chuck Grassley supported the provision through an amicus brief. Grassley noted that the False Claims Act serves as a primary tool for combating government fraud, stating that the decision will save billions of taxpayer dollars and deter future fraudulent activity.

Since its update in 1986, the False Claims Act has recovered approximately $85 billion for the government. In fiscal year 2025 alone, the act has identified more than $6.8 billion in fraudulent payments.
