Minnesota AI Nudification Ban Enforced as xAI Lawsuit Rejected
Minnesota’s new law banning AI‑generated non‑consensual nude images—known as a “nudification” ban—takes effect on August 1, 2026. The legislation, passed 132‑1 in the House and 65‑0 in the Senate, imposes civil penalties of up to $500,000 per violation for platforms that provide or allow such technology.
A federal judge, U.S. District Judge Donovan Frank, denied xAI’s request for a temporary restraining order, noting that the company filed its motion weeks after the law was signed and only days before it was set to become operative. xAI’s lawsuit, filed in late July, argues the statute is overbroad and violates the First Amendment, though the company acknowledges the law’s goal of stopping non‑consensual deepfakes. Attorney General Keith Ellison defended the ban, saying it protects the dignity of Minnesotans. The case will proceed, with further hearings scheduled.
