Emma Shapiro sues Instagram over account suspension and censorship

Artist Emma Shapiro's Instagram account @nipeople, part of her "Exposure Therapy" project that featured images of female nipples, was permanently terminated by Instagram in December 2025 for alleged violations of community standards. Shapiro, a US‑born artist residing in Spain, has launched a legal challenge with the help of Avant‑Garde Lawyers, arguing that the suspension infringes her freedom of expression.

The lawyers filed a complaint with Spain's Comisión Nacional de los Mercados y la Competencia (CNMC), invoking the European Union's Digital Services Act. They claim Meta failed to give a clear justification, denied Shapiro access to an effective internal complaints process, and acted disproportionately. "Meta failed to provide a sufficiently clear statement of reasons for its decision," the lawyers said. Shapiro added, "This case is personal, but the issue is systemic," highlighting concerns over opaque platform moderation of artistic content.

The dispute underscores broader debates about digital platform responsibility, artistic freedom, and the enforcement of the EU's new online‑content rules.
