Emmitt Smith sued over alleged misappropriation of wind farm loan
Former Dallas Cowboys running back and Pro Football Hall of Famer Emmitt Smith, along with business partner David Mosley, is facing a lawsuit filed in Delaware by Kituwah LLC. The Native American investment company, which seeks to fund opportunities for the Eastern Band of Cherokee Indians, alleges that Smith’s company, 4 13 Solutions, misappropriated a $2.5 million loan.
The funds were intended to support Project Exodus, a wind farm project located between Austin and San Antonio, Texas. Kituwah LLC claims the money was instead used to repay an investor from previous dealings involving Smith’s company. Attorneys for Kituwah described the situation as being ‘essentially, like a ponzi scheme,’ alleging that Smith and Mosley misrepresented their progress in securing a U.S. Department of Energy loan.
The lawsuit states that the defendants provided excuses for why the project was not proceeding and eventually stopped responding to requests. Kituwah is seeking damages for the principal amount plus approximately $600,000 in accrued interest.
