EPA proposes faster NEPA review timelines for infrastructure

The Environmental Protection Agency (EPA) has introduced a proposal to accelerate National Environmental Policy Act (NEPA) reviews, aiming to reduce the average completion time for Environmental Impact Statements (EIS) from four years to two years. The proposal includes implementing firm deadlines, page limits, clearer scope rules, and expanded use of categorical exclusions to reduce uncertainty for infrastructure developers.

While the EPA intends to speed up development for energy, transportation, and water projects, the move has sparked debate regarding the balance between efficiency and environmental scrutiny. Critics express concern that shorter timelines could potentially weaken public oversight.

Parallel discussions regarding NEPA reform also focus on legal remedies. Organizations like the Institute for Progress have suggested reforming how courts handle violations. Current legal challenges often involve preliminary or permanent injunctions and the vacatur of agency actions under the Administrative Procedure Act. Reformers argue that the ability to stop entire projects due to minor procedural errors can be used strategically to block diverse infrastructure, including renewable energy projects like wind and solar farms.
