EPA proposes rule to reduce public input on data center pollution permits

The Trump administration is proposing a rule change through the Environmental Protection Agency (EPA) that would reduce public oversight of data centers. The proposal aims to eliminate a federal requirement under the Clean Air Act that mandates states to publicize and solicit public input on air pollution permit applications for industrial facilities, including new data centers and the power plants required to operate them.

Under the proposed rule, air pollution disclosures would become voluntary at the discretion of state and local officials. Critics, including former EPA assistant administrator Joe Goffman, suggest the move is intended to circumvent public opposition. Data centers have faced growing backlash across the United States due to concerns regarding noise, power consumption, and pollution.

President Trump has defended the expansion of data centers, stating that communities refusing them are “making a mistake” and emphasizing the potential for jobs and tax revenue. While the public comment period for the rule has concluded, the measure may face legal challenges if finalized.
