Erdoğan rejects draft proposal on indefinite alimony

President Recep Tayyip Erdoğan has rejected a draft legislative proposal regarding the removal of indefinite alimony, instructing that the regulation be reformulated to prevent potential grievances among different social groups.

The draft, prepared by the Ministry of Justice and the AK Party Group for inclusion in the 13th Judicial Package, followed a Constitutional Court decision to annul the term “indefinitely” in Article 175 of the Turkish Civil Code. The initial proposal suggested determining alimony duration based on the length of the marriage. For example, marriages lasting up to 10 years would trigger 5 years of alimony, while marriages exceeding 10 years would result in alimony for half the duration of the marriage.

Internal disagreements within the AK Party and concerns regarding the fairness of the marriage-duration model have led to a search for alternative formulas. New discussions are focusing on criteria such as the economic and social conditions of the parties, as well as their ages, to ensure a more balanced outcome.
