EU AI Act mandates labeling of AI-generated content and deepfakes

Under the European Union's AI Act, new regulations regarding AI-generated content have come into effect. As of August 2, 2026, entities using systems to generate or modify content must inform recipients that the material has been artificially produced or altered.

This transparency requirement specifically targets deepfakes—realistic images, audio, or video that could be mistaken for authentic. While exceptions exist for artistic, satirical, or fictional works, the obligation remains to disclose AI use in a manner that does not hinder the viewing experience. The rules also apply to AI-generated text intended to inform the public on matters of interest.

Despite these labeling requirements, the implementation of rules for high-risk AI systems has been delayed to allow for technical adjustments. Additionally, in legal proceedings, the burden of determining the authenticity of digital evidence continues to rest with investigators and forensic experts. Workshops are being organized to address the growing challenges deepfakes and AI-generated child sexual abuse material (CSAM) pose to global forensic investigations and legislative frameworks.
