EU and France face challenges over social media bans for minors

European Commission President Ursula von der Leyen is expected to propose a ban on social media use for minors under the age of 15. The announcement is anticipated during her State of the European Union address on September 16, 2026, in Strasbourg. This legislative move follows the ‘Child Safety Online’ expert report, which aims to mitigate mental health issues, addiction, and other harms caused by unregulated access to large tech companies.

In France, a similar attempt to ban social media for those under 15 was recently struck down by the Constitutional Council. The Council ruled on August 14 that the measure constituted a ‘disproportionate infringement’ on the freedom of expression and communication of minors. While acknowledging the need to protect children, the Council noted the ban was too broad and could affect services where specific health and safety risks are not established. Following this ruling, President Emmanuel Macron has expressed intent to draft new legislation.
